This sales order is a binding contract for the production of custom products and is not cancellable. CANCELLATION. All sales are final. No cancellations, exchanges, or returns are accepted once a deposit has been submitted and the order process has begun. This sales order is a contract for a special ordered item and therefore cannot be cancelled. (Customer Initials). It is acknowledged that Hastens has specifically discussed the custom nature of this order and I understand that, once processed, the order is not cancellable. RETURNS. In limited circumstances, Hastens, in its sole discretion, may agree to accept the return of an item. In such a case, your refund will be reduced by a restocking charge equal to 25% of the purchase price and you will be responsible for outbound and retum shipping and delivery charges. Returns must be received in original condition within 30 days. Credit card orders will receive refunds in the form of a credit back to the original account. Check and cash payments will be returned via a refund check or Hastens Merchandise Credit. 16 CFR 1633. Hastens beds meet the requirements of the Federal Standard for the Flammability (Open Flame) of Mattress Sets, 16 CFR 1633 as specified on the 1633 law label. To ensure your mattress set and foundation is compliant with the 16 CFR 1633 standards, you must use a Hastens foundation with your Hastens mattress. PAYMENT. A 50% deposit is required to process the order. By signing this agreement, the Customer agrees that upon the arrival of its purchased item(s) to the Hastens warehouse or similar facility, the final payment will be due. The balance of any order must be paid in full no later than 10 business days of receipt of goods to the warehouse. For those Hastens items that may be in stock locally, Hastens requires 100% payment at the time the order is placed. No products will be delivered until full payment is received. If payment for any part of an order is made by check, delivery cannot be made for a minimum of 5 days following payment to allow for check clearance. DELIVERY. Estimated delivery time is 10-12 weeks. A Hastens representative will confirm the delivery date once the product(s) arrive at the Hastens warehouse. Depending on the merchandise location, this delivery date is estimated and not guaranteed, and is therefore subject to change without notice. Hastens will not be held accountable for delivery date changes due to international shipping delays, stock shortages or any acts of God. No order can be cancelled due to excessive delivery times. Please do not make arrangements to have the Customer's current bed removed until a third-party delivery company or a Hastens representative has contacted the Customer regarding delivery of the Hastens products. Hastens will hold your order in the Hastens warehouse for up to 30 days from receipt of goods, provided the balance of the order is paid in full. The Customer may arrange to have goods held in the warehouse past this time period by making arrangements for the payment of storage fees directly with the Hastens warehouse. Hastens reserves the right to utilize a third-party delivery service for your convenience. All delivery quotes and charges are estimated and subject to change without notice. Hastens will make arrangements for the delivery of your Hastens bed to the delivery address provided as well as the set up and removal of packaging. All other services and changes to this arrangement are at the Customer's discretion and will be charged to the Customer accordingly. The Customer also has the option of making their own Customer Signature Date Reference Number: Quote-044418 Page 2 of 4 EFTA00523375 arrangements for delivery which will absolve Hastens of any insurance liabilities, fees and filing responsibilities. The Customer is responsible for the deliverability of its Hastens product. Please make sure to note any delivery obstacles that may occur when delivering your Hastens bed such as doorways, hallways, elevators, stairwells and windows. If the Customer orders a bed and it does not fit into your space, Hastens will not be responsible. If the Customer has any doubts, please ask Hastens representative to set up an appointment for a survey by the delivery company for an additional fee. DEFECTS/NONCONFORMING DELIVERY. Please be present during your delivery or have an authorized representative present. Please inspect your item(s) before signing for receipt of goods. If there are any discrepancies or damages to your item(s), please note them on the shipping document provided by your delivery company. If damages occur to any other items or structure during delivery please note this on the delivery slip. ANY DAMAGES NOT NOTED WILL FORFEIT A CLAIM. Please be as specific as possible on the document. Please submit the original shipping document to the Hastens store which the Customer purchased the products as well as retain a copy for yourself. The Customer must notify Hastens of any defect or other issues regarding delivered products within 24 hours following delivery. If the Customer does not notify Hastens within 24 hours of delivery, unless otherwise covered by an applicable Hastens warranty, any and all issues regarding their delivery are no longer the responsibility of Hastens. VARIATIONS. There may be slight variations in the size and color of Hastens products from the showroom samples. Such variations are normal and do not affect the performance of the products. Hastens makes every effort to ensure that such variations are as minimal as possible. PERFORMANCE OF NATURAL MATERIALS. Hastens products are crafted with natural materials that, by their nature, vary and adjust with the passage of time. One of the natural and desired results of these adjustments to the natural materials is the contouring of the product to the shape of the Customer's body. This contouring or "settling" is a feature of Hastens beds that is intended and can be maintained through a regular practice of rotating and flipping the beds. (Customer Initials). It is acknowledged that Hastens has specifically discussed the performance of the natural materials present in all Hastens products. Any contouring or settling of the materials is expected and not an indication of any sort of defect in the products. WARRANTY. Hastens beds are covered by a 25-year limited warranty against spring and frame breakage extended to the original purchaser. The applicable limited warranty will be provided to the Customer at the time of delivery. Hastens makes no other warranty whether expressed or implied. This warranty is not extended to goods which have been damaged through unreasonable or improper use; which have not been properly maintained; are accidentally damaged (including unauthorized repairs or alterations); are in a soiled or unsanitary condition or are willfully damaged. Product warranties are non-transferable. For adjustable beds, the motor is guaranteed for 5 years. Exclusions to this warranty include the top mattress, accessories and bedding items. The original Hastens store documentation. 2. The 25 Year Limited Warranty and Consumer Law 2t g at the foot of your Hastens bed, with the serial number and signature of inspector. 3.
