This request was first submitted by email to Ms. Shani Pinney, the Sex Offender Registration Coordinator, who informed me that I should seek authorization from the Attorney General by means of a formal letter detailing the specific request and the reasons therefor. By email dated January 23, 2013, I sought the advice of Ms. Pinney as to whether it would be acceptable for Mr. Jeffrey Epstein, whose registration anniversary is March 5, to renew his registration prior to March 5, 2013 during the first two weeks in February 2013. In that email and a subsequent telephone conversation with Ms. Pinney on that same date, I explained that as a result of a change in Mr. Epstein's travel plans necessitated by the weather, Mr. Epstein had to cancel his trip to Paris, France and reschedule the trip for the beginning of March 2013. Moreover, as a result of this rescheduling and Mr. Epstein's other business and professional commitments, it appears that Mr. Epstein will be required to travel outside the Virgin Islands for the entire month of March 2013. In order to ensure his compliance with Virgin Islands registration law, Mr. Epstein is seeking confirmation from the Attorney General that he may renew his registration in early February. Mr. Epstein is returning to his permanent residence in the Virgin Islands on January 27, 2013. Following his return to the Virgin Islands and for the first two 1 EFTA00589670 weeks in February 2013, there are no meetings, appointments or commitments scheduled that would require Mr. Epstein to travel outside of the Virgin Islands. Because this period of no travel is a relatively rare occurrence for Mr. Epstein, and there is still some uncertainty as to whether he will be required to travel to meet business and professional obligations during the latter part of February, we respectfully request that Mr. Epstein be permitted to renew his registration while he is certain to be on Island during that two week period. If Mr. Epstein receives your authorization, he would coordinate with Ms. Pinney to ensure that he renews his registration at a date and time during the two weeks following his January 27, 2013 return to the Virgin Islands that is convenient for Ms. Pinney. Although 14 V.I.C. Section 1724(d) previously specified that Mr. Epstein was required to verify his address with the Department of Justice "annually on the anniversary of his initial registration date" (i.e., March 5 of every year), that law was amended by Act No. 7372 on July 18, 2012. As amended, Section 1724(d) now requires only that Mr. Epstein "appear in person at the Department of Justice for the purposes of verification and keeping [his] registration current .. . once every year for 15 years from the time of release from custody . . . or from the date of sentencing . .." Thus, under the amended law, no particular date for Mr. Epstein's annual verification is specified. Mr. Epstein has maintained strict compliance with his Virgin Islands reporting and registration requirements throughout the entire three years that he has been registered, and he will continue to do so. Consistent with his well- established compliance history, Mr. Epstein is seeking to renew his registration prior to commencing a particularly lengthy period of travel for business and professional purposes. As no particular date for renewal is specified under the amended law, Mr. Epstein is merely seeking confirmation from the Attorney General that Mr. Epstein may comply with 14 V.I.C. Section 1724(d) by appearing at the Department of Justice to renew his registration during the first two weeks in February 2013. He is requesting this confirmation so that he can continue to remain in full compliance with his Virgin Islands registration obligations, while at the same time satisfying the demanding travel requirements of his business and professional life.
