EFTA00600423 5-18-06 Emad, I have been out of the country for much of the last 10 days. I had a very brief conversation with Juan concerning the refund right before leaving, however, we were not able to end that conversation with any purposeful conclusion. He explained to me that a refund in totality is not doable right now. Apparently, he has spent much of the money in Puerto Rico as deposit moneys for the Coconuts as well as attorney and travel expenses. He made 7 trips there for this failed operation. He tells me that he could come up with about $10-$15,000 now and remit the balance within the next several months or preferably, ship the original Coconut palms (35-40 trees or more). If, the balance is done in Coconuts, he can quickly get the same size trees to the island, for the same price, in weeks. If the balance is done in dollars, he tells me that it will take thru the summer months. He obviously has a serious cash flow problem right now, however, he has an order of 4-500 Coconuts in August which will relieve much of the cash flow misery. I encourage Jeffrey to take the trees. This was a very unfortunate incident but I suggest shipping delay from PR was out of his control with the current extraordinary circumstances. The government of PR simply shut down. I suggest this problem was ongoing for many months and filtered down to the environmental and agricultural departments. He was not aware of the government's difficulties. He has shipped out of PR without any problems in the past. This environment created the backlog of processing the operation and, I believe, the government workers that he was dealing with had no interest in job performance. He has great trees in south Florida. I will tag the trees with him. Jeffrey can get the same size material and here it can be processed quickly. I am somewhat embarrassed by this incident but also understand that the scenario was quite unusual and simply created a mess for all. I have included a couple of coconut palm photos that are currently in his inventory. Juan is troubled and embarrassed by this ordeal as well. He, and I, would still like to fulfill this order by shipping quality trees to the island asap. Please let me know how you would like to proceed. I also never received any messages from last week, at least most of the week, if you left any. I had all my computer and phone services disabled from trades people working around my office. It came back to life on Monday. But, I did finally speak to juan yesterday and this is the latest. We are still having difficulties with the pr government but he has drawn some options: I. Dig the Coconuts from the existing site and move them to a site nearby, within 20 miles, that is already certified for landscape tree digging. He has one site in mind and believes this is very doable. His expense will obviously be greater but he is willing to take the hit so the order can be processed. The trees will still need to be quarantined for a period of 20.40 days regardless. The digging and transference will take another 10-14 days as well. 2. Option 2 is still an uncertainty. He has been told by associates in pr that there is another existing and certified field of coconut palms. He does not know where that field is yet but thinks he should know by Tomorrow and will then need to check out the sizes, quantity and quality of the material. IF, this option pans out, this operation can be processed within 2-3 weeks since the field is already certified. Only the digging operation and loading on ship will need to be completed. I will let you know as soon as I know something. 3. Option 3 is, I suggest, a last resort. He has larger coconut trees here in south florida. He can collect from the various areas and have an order assembled at his nursery within 2-3 weeks. He tells me that That he has hundreds of good looking coconuts down here of the required size. I certainly would inspect these, as well as have your reps come here to do the same. The freight is going to be much more Money than the pr option 1 & 2, but he tells me that the trees are less expensive and he, again, is willing to accept the hit to process the order. So this is the latest information. I hopefully will receive more today regarding option 2. I realize that this has taken much longer than anyone expected, especially Juan. He has worked pr before but never has been in this type of bureaucratic entanglement. He needs to get thru this because he has other orders for island work and pr has been a good resource for him. He has had his attorney and some others working the officials. They seem to have connected more effectively than juan. Juan believes that they have a perception of him as being some fat, abusive American so he let the others work it. He has suggested to me that his attorney feels that he can complete the mission but will take more time. I am nervous that Jeffrey is losing faith in the process. I obviously want this shipment to be processed asap. I feel somewhat embarrassed by the ordeal but still appreciate that unfortunate circumstances can occur especially when working with a bureaucracy, and apparently this one down there. We have even had some moments of entertaining the idea of enticing the officials with some monetary incentives but quickly walked away from that concept. I will call Jeffrey today about all of this.
