ACTION FOR BREACH OF CONTRACT AND FRAUD JURY TRIAL DEMANDED PUNITIVE DAMAGES SOUGHT JUDGMENT BEFORE THE COURT is Plaintiffs' Motion for Default Judgment and Motion for Award of Costs and Attorneys' Fees. Having considered the Motion for Default and having conducted a hearing on the same on December 10, 2012 at which time the Court heard testimony from Plaintiff's witness Darren K. Indyke and received exhibits into evidence including a custodian of records affidavit from Richard Kahn, and after entering the Court's findings on the record, the Court entered judgment on the record and now reduces the same to writing. Accordingly, it is hereby ORDERED ADJUGED & DECREED that Plaintiffs' Motion for Default Judgment is GRANTED; it is further ORDERED ADJUGED & DECREED that Plaintiffs are awarded judgment of compensatory, contractual, and consequential damages against the Defendants Nick Lambros and AVLC, LLC d/b/a Sound X, joint and severally, in the total amount of $196,000.56 plus punitive damages in the amount of $50,000.00 for a total amount of Two Hundred Forty-Six EFTA00622677 Thousand Dollars and Fifty-Six Cents ($246,000.56) with post judgment interest at the statutory rate of 4% from December I0, 2012 until this judgment is satisfied; it is further ORDERED ADJUGED & DECREED that Plaintiffs are awarded in costs and in attorneys' fees as the prevailing party in this matter.
