The attorneys have gone back and forth now for several weeks. Among the remaining issues to hammer out is a "relocation clause" that the building is insisting must stay in the lease. It says that once during the life of the lease, with 60 days notice, they can "designate" space, no less than 85% of what we have, in substitution of the space we have leased. They have agreed that the space would have to be northern facing and above the 25th floor (which gives a clear view of Central Park like we will have in the space we are taking) but just make reference to a "comparable layout" (which we would get to approve but must respond to within 10 days). They will cover all costs but there is no guarantee that new space would not have a greater component of interior space as opposed to the large amt of windows in the space we are taking upfront. Can you give me opinion as to whether this is a common clause that I must live with because we are only a 3300 SF tenant? In some ways I am tempted to threaten to walk. Thanks!!
