WEINBERG: I don't think I can reliably respond except to say that there was some discussion about whether or not he was required to physically appear in New York. And my understanding from the lawyers with personal knowledge is he was told that unless he was here nine or more days a month, he was not required to conform to the physical 90-day appearance, despite being a tier 3. THE COURT: He wouldn't have to come. MR. WEINBERG: Right. Nobody has ever given him or noticed a violation in almost ten years of daily monitoring. He's not someone that just stays at one location.
