Log slips are different than 30 minute rou
rts. We don't have any log slips. Do you want us to add the information
about the 30 minute round report, which
ent to us.
On the video, we don't know exactly. FBI took all of the video for the whole MCC. Half the system was down, so they
don't really know what they have yet. Will know more once CART starts looking at it.

On the first, I think you should add info from the log slips we do have and the admission from the report
On the video, can you explain (even generally) where the video is of?

We got an attorney proffer from
lawyer regarding the last call on Friday. Epstein did not say goodbye
or anything to indicate he had decided to end his life. He said "they are trying to keep me safe," talked about
music and a book, and told her his case might take longer than he thought and he probably wouldn't be able to
talk for another month. We are going to set up a phone proffer with her early this week and are pulling her tolls.
She is in Belarus. She said it was a 20 min conversation but we were told by BOP said it was a 10 second
conversation, so we are drilling down on that.
We got the answers t
questions, they are below and we will forward them assuming you guys don't
have any issues with t ese:
I. OIG requested all of the log slips from BOP this morning.
2. There was a camera pointed at the hallway of the SHU that, according to what we were told by BOP
yesterday, was not functioning as of Thursday. However, FBI seized 18 hard drives of videos and are analyzing
them to confirm there was no video.
3. Epstein's cellmate
was released from Court on Friday. Epstein was not on suicide watch (he
was only on suicide watch trom //23-7/29) so he was not required to have a cellmate. There was not an officer
required to assign him/responsible for assigning him a cellmate. CMG has not spoken with any officers as of
yet.

We plan to reach out to the supervisor who wrote the memo we circulated last night for a voluntary interview.

Be careful that you are actually talking to NYPD and what you say. There appears to already have been a
hoax call to defense about the body yesterday. Don't reveal a thing.

That makes sense. I'll tell the NYPD Sgt that.
Yes, the defense arranged to have a pathologist present this morning and the autopsy is going on now. It
was supposed to start at 9.

I view this as an FBI issue - if they are aware of the invite and don't want to be there, I'm fine with that.
This reminds me - did we ever resolve the issue of defense counsel wanting to have their expert present
and asking to move this to Tuesday?

Correct, that's our theory.
rote:
Based on our read of the statute and the relevant CA2 law that we looked at last night, it covers the
falsification of a record within the jurisdiction of a federal department or agency, including the BOP.
We'll continue to drill down on this though.
Separately, NYPD just called the office (this is coming from a CSO) to confirm whether or not the
investigation wanted to have someone present at the autopsy like an investigation or agent. I know
NYPD sometimes likes to have a presence at high profile autopsies (and I'm guessing this is coming
from a random NYPD person just confirming) but I don't think we need an FBI agent present and they
weren't planning on it. You guys ok with that?

On 1519, I should know this, but does the statute apply to the falsification of any document created by
the BOP? Or does it require, as the header might suggest, that the record be relevant to an
EFTA00066539
investigation at the time it is falsified?

Ok. So sounds like we are talking about a 1519 based on false report and admission but will want
to corroborate to extent possible admission that they did not do rounds.

said that there was no other interview, and none of the guards have
been interviewed by OIG. Apparently the shift had changed by the time OIG got there, and they didn't
want to interview people without consulting with us. We have some work to do before this is
chargeable, so here's where things stand:
FBI seized 16 hard drives of video and are analyzing it. We will call them tomorrow morning to
make sure they're doing it as expeditiously as possible. They are looking to see if there was
tampering with the video, if there is any other useable video, or if there is video of where the
guards were when they weren't checking on _IE.
There were 9 guards assigned to the SHU last night. There is a communal room for the guards
adjacent to the SHU with a computer and a phone. OIG seized the computer and are analyzing it
as quickly as possible (to see if there is a way to track who was using it, what they were looking
at, etc.). 016 is getting us toll records for the phone in the communal room.
OIG will send us the personal phone numbers for the 9 guards, and we will send preservation
letters for texts and will get tolls as soon as possible, with an eye towards drafting SWs for any
personal devices if there are tolls between them today or tomorrow, or during the relevant time
period last night (guards are not allowed to have phones in the prison so that would be another
issue).
OIG is pulling the BOP emails for each of the guards, and is getting us a list of their assignments
last night. They are also confirming whether there is a way to track guard movements, but we
believe they use a physical key so there wouldn't be electronic swipe records.
We'll continue to keep you posted, thanks.
