First, it has come to my attention that Mr. Epstein is again trying to obtain work release, contrary to the terms and spirit of the Non-Prosecution Agreement. This also directly contradicts the conversation I had with Jack Goldberger the weekend before Mr. Epstein's guilty plea, wherein Jack confirmed that Mr. Epstein would be in custody and would aol seek work release during the 18-month term of incarceration. Please advise whether Mr. Epstein is, indeed, requesting work release. Second, Stuart Mermelstein of Herman & Mermelstein P.A. has filed an Ethics Complaint with the Florida Bar asserting that the letters to the victims advising them of their rights under the terms of the Non-Prosecution Agreement violate a series of Florida Bar Rules. In the context of my response to that Complaint, I anticipate that the Ethics Counsel will need to review the entire Agreement. If you have any objection to that disclosure, please let me know so that I may communicate that to the Ethics Counsel. Please provide answers as promptly as possible. Thank you for your assistance.
