Public Corruption Unit Short Form Updates April 2, 2021 A. SIGNIFICANT DEVELOPMENTS IN CASES EFTA00090101 US v. Ghislaine Maxwell USAO 2018R01618 (AUSAs : On June 29, 2020 a grand jury returned a six count indictment charging Maxwell for her role in facilitating Epstein's abuse of minor girls. Maxwell was arrested on July 2 at a residence in New Hampshire and has been detained since. EFTA00090102 The team made an initial discovery production on or about August 21, 2020, and is working on a second discovery production of electronic materials in the coming month. The team is also working with the USAO-SDFL, OPR and the West Palm Beach Police Department among other sources to obtain and review materials relevant to the prior investi ation. Additionally, the team is in the process of reaching out to counsel for to begin initial discussions about the possibility of a felony disposition. We are also continuing to pursue a potential interview with Prince Andrew, and after his counsel declined to make him available for a voluntary interview, we notified OIA that we wished to proceed with an MLAT. We completed discovery in November 2020. Maxwell's second bail application was denied in December 2020. Pretrial motions were filed in late January and include anticipated motions to dismiss the indictment based on the NPA or, alternatively, the statute of limitations; motions to suppress materials obtained from Boies Schiller pursuant to grand jury subpoena and from the civil case; and various discovery related motions, including ones seeking a bill of particulars and/or early production of Giglio and 3500 material. On February 26, the team filed an omnibus brief in opposition to the defendant's pretrial motions. A reply brief is due on March 15. Maxwell has also recently filed a third bail motion. Our brief in opposition is due March 9. Trial has been adjourned to the fall of 2021. Judge Nathan recently denied Maxwell's pretrial motions but deferred ruling on a suppression motion related to materials obtained via a subpoena to a law firm. Maxwell's bail appeal to the Second Circuit was recently denied as well. EFTA00090103
