As you are aware, between August 10, 2019, and August 16, 2019, at OCME's request, the USAO and FBI provided certain materials and information to OCME that the FBI and USAO obtained through their investigation, in order to assist the OCME in determining the cause and manner of Mr. Epstein's death. However, those materials are sensitive law enforcement documents that relate to the ongoing criminal investigation, and as set forth below, should not be disclosed to any third parties. In order to avoid compromising that ongoing criminal investigation, we request that OCME withhold from disclosure to any third party, except to the FBI, any documents or portions of the OCME case file that include, reflect, or contain information from any records or documents from the MCC. This includes, but is not limited to, MCC's disciplinary records, medical records, psychological records, investigative reports, photographs, interviews with MCC staff, or surveillance footage. We also request that you withhold from any disclosure the names and identifying information of any law enforcement agents at the FBI and the MCC that were interviewed by any OCME staff, along with the substance of any of those statements or interviews. In addition, we request that you return, or confirm the destruction of, any draft FBI interview reports, including the interview report fo That draft report is FBI property and should not be retained by the OCME.
