The answer is that a defendant can't be subject to more punishment than whatever the penalty was at the time of the offense. So, normally we're prosecuting people who committed crimes recently, so whatever the current law is applies to them. Here, the maximum sentences for these offenses were different back in 1994-97, which is the time period of our charges, and the maximum sentences were less at that time than they are now. Thx Sent from my iPhone Begin forwarded message: From: CAL < Date: July 6, 2020 at 10:53:55 AM EDT To: Subject: Ghislaine Maxwell maximum sentence --a doubt Hi a Sorry to bother but I saw on Maxwell detention memo that "the defendant faces up to 35 years' imprisonment if convicted". But I saw one of the charges is US Code Title 18 2423 which carries a max sentence of life... I am confused. Do you know why she faces up to 35 years and not life? Thanks very much, Kind regards, AFP 18 U.S. Code § 2423.Transportation of minors (a)TRANSPORTATION WITH INTENT To ENGAGE IN CRIMINAL SEXUAL ACrIVITY.— A person who knowingly transports an individual who has not attained the age of 18 years in interstate or foreign commerce, or in any commonwealth, territory or possession of the United States, with intent that the individual engage in prostitution, or in any sexual activity for which EFTA00102398 any person can be charged with a criminal offense, shall be fined under this title and imprisoned not less than 10 years or for life.
