was Control One from 4 pm until midnight, and on Aug 10, 2019, he was
Internal Two from midnight until 8 am.
Page 16: Control One is the eyes and ears of the LT.

worked with him on Aug 9 as Internal Two. That position is supposed to do the counts.
Page 22-23:
: All right. But as control number one, the day before, you weren't
actually supposed to be involved with the counts?
MR. =:
No. The only thing I do is sit there. Once you (internal Two) complete the count and you tell
me, and we have a good verbal, I announce it on the radio, I log it in the logbook, and then, you say,
clear count. I announce it on the radio. Write it in the logbook. Clear count.
Page 23: Didn't think it was

Page 25: Internal Two leaves at 10 pm. He was supposed to print everything, and then
would take
the paperwork and do the count for him.
Page 26: Someone had an idea to save money and have Internal Two leave at 10 rather than 12 am.
Page 27: He would have been the one who took the count at 10 pm because he would have been the
only one in control.
Page 28: Also took the Aug 10 12 am, 3 am, and 5 am counts.
Page 30 Reported to the Ops Lt, who was
during the counts.
Page 36: Responded to Epstein's alarm at 6:33. When he arrived, other officers were on scene. He
assisted and followed the ambulance to the hospital. He stayed at the hospital until he was relieved
from duty.
Page 41: Went over the 10 pm count. Said his handwriting was on the count form and he wrote "good
verbal" at 10:30 pm.
Page 42: He was the one to make all the cross offs on the counts slips. Didn't know why he didn't cross
out the SHU count slip. The 95 + 1 on the R&D and the + 1 on the ZA were his writing.
Page 44: The SHU count slip should have read 73 —1. Positive the 9S + 1 was his handwriting but wasn't
sure about the 73 + 1.
Page 45: Said an Ops LT had to authorize, but couldn't remember if he spoke with an Ops LT.
Page 46: Said he dropped the ball on this one.

Page 51: The handwriting on the count slips had to be done at 10 pm. "The count didn't clear until
10:36. And so, this probably was during that timeline, from either 9:58, from 9:55 to about 10:15"
Page 51-52: Asked why the internal system was corrected until 12:35 am, if it was learned that he was
not in the SHU at 10 pm. And why did the SHU count slip still say 73 at 12 am.
Page 57-58: Didn't recall any conversations with the SHU and didn't recall
speaking with
the SHU.
Page 58-59: Said he didn't not believe the +1 on the ZA count slip was his, but was positive the 9S + 1
was his handwriting. The said, "But it could be. It could be."
Page 61: "I should have caught it. I should have said something about it."
Page 62: SHU personnel would have told him to put the + 1.
Page 63: "I mean, you could still do the count, but if somebody, you know, higher up said, yo, this is
what you need to put on the count slip, that's what you put on the count slip. Now, you know, like,
somebody dropped the ball."
Page 63: Asked if SHU told them at 10 pm, why did their count slip still say the wrong number at 12 am.
Page 65-66: The El was printed at 0035, at the same time the inmate was keyed out of the SHU.
Page 66-67: Didn't recall anything but knew the 95 on the count slip was his handwriting. Believed he
would have wrote it per the Ops Lt.
Page 68: "I wouldn't have did this because I would have known this is, you know, this will come back and
bite you in the ass if I did this after." Said he wouldn't have gone back after the 12 am count and wrote
on the 10 pm count slips. Couldn't recall a conversation with

Page 72-74: I should have taken it upon myself to generate a new El. Th count slips (for R&D and the
SHU) should have been trashed, and new counts slips should have been generated.
Page 80: Never knew the counts slips were off and this was a problem until now.
Page 83: Just didn't remember what took place and what happened.
Page 84: Said the 4 pm, 10 pm, and 12 am count slips provided by the SHU were all bad/inaccurate
because
was moved to the R&D holding cell at 3:15 pm but was never removed from their
count.
Page 90-92: Control Two should have keyed
out of the SHU and into R&D. The schedule says
that Marugo was Control Two on the 9th.

Page 97: If the call out lists said
WAB, then they should have known he wasn't going to return.
Page 99: "If it says WAB, he's definitely not coming back." However, in rare instances, there have been
inmates who were WAB and didn't leave.
Page 100:
: But if by, for instance, he leaves at 8:00, he's WAB, by 2:00 p.m., if he's
not back, that means, certainly, he got off on the transport. Does that mean, basically, by 2:00 p.m., if
somebody that's WAB is not back, they're certainly not returning?
MR. =I: Yes.
Okay. And in this case, if someone is WAB, would control have any — or internal -
have anything to do with, at the 4:00 p.m. count, contacting SHU, to make sure that they're aware that
that WAB person, in fact, isn't coming back?
MR. =:
No.
Page 115: Control may not have been notified about
so they may not have known to key him
out of the SHU. It should have happened at 3:15. The SHU should have been notified and then should
have contacted control and told them to make the necessary key entries.
Page 119: If the SHU conducted the 4 pm count, they would have caught the mistake.
Page 125: Do not know for a fact that the handwriting on the SHU counts slips occurred during the 10
pm count. But pretty positive it was written during the 10 pm count.
Page 126:
: Well, it sounds like you knew it. I'm just - now, I'm just super confused if
that's when it happened, why the El, you have a count slip that doesn't say on the El.
MR. =:
Like I said, if, you know, if I'm correct, I should have changed it.
You should have changed the El?
MR. IMMI: I should have just changed it, regardless.
