- SHU OIC on August 911' until 10 pm (pg 15) Cause of death: -"He hung himself in the cell." No info on suspicious activity. No knowledge of anyone taking Epstein's life. No knowledge of others assisting in taking Epstein's life. Assumed Epstein acted alone in taking his life. No involvement with taking Epstein's life. (pg 154 - 155) -A cellmate would have helped prevent his death. (pg 155) Additional info -He brought Epstein back from the shower area around 9:30 pm (pg 31) -Prior to his departure, he went to Epstein and asked if he was "good." Epstein gave the thumbs up in response. (Pg 45) -He recalls putting Epstein back in his cell from the shower area and asking Epstein "where the hell is your fucking cellmate at?" (Pg 85) swore again that he caught the fact that was missing around 9:30 pm and notified and MI regarding that fact. He clarified that he made a phone call but he is not sure if it was to a LT, Unit Manager, or someone else. (pg 127) -He thinks there is a possibility he would have called the control center and spoken to M , or about Epstein missing his cellmate. (Pg 161) Did not conduct cell searches (pg 170) Never saw any cell search conducted on the evening shift (pg 172) "Tragedy that he's gone, I wasn't here, I didn't have anything to do with it" (pg 179) — worked in the SHU on August 9th from 4 pm until 12 am with and (1g 302) -At approximately 7:30pm, there were two (2) inmates, same cell, last cell to the left in LTier, that said they were going to hang themselves. Acting LT was called and the inmates were put in Suicide Watch. After this incident, started crashing. His feet started to hurt and he was really tired. -EPSTEIN came back to SHU around 8 pm and he was put back into his cell on L Tier. -EPSTEIN was fed about 15-20 minutes after he was put back in his cell. He seemed "normal". -After EPSTEIN received his food, and left the L-Tier area. EPSTEIN was alone in his cell. 2^d 302 helped with the feed, which is when the Officers take food to the inmates. This usually happens after the 4pm count clears, which is usually 5pm. But on this day, it could have been earlier than 5pm. then picked up the food trays after the feed. It was either during the time he was picking up food trays or after that did the rest of the commissary in the SHU. said that he spent no more than 60 seconds on L-Tier when he delivered food to Epstein that night. didn't recall if he or another Officer went back to L-Tier after Epstein was fed. During the rest of his shift, said that he was mostly sitting at the desk or was near the desk so he would have seen if someone went up to L-Tier. EFTA00141166 -M left between 9:55pm-10:00pm. before he left. He didn't remember going up to Epstein's cell but stated that may have waved or gave a head nod to Epstein, whose cell one can see from the desk. also stated that had told him that he waved to Epstein before he left. was relieved at approximately 11:50pm on August 9, 2019 didn't know if went up to L-Tier - OT shift as the Activities LT from 4 pm to 10 pm (pg 13-14) Cause of death: -Didn't find Epstein's death to be suspicious, even with all (Page 123) Additional Info of the underlying circumstances. -"So in Special Housing, inmates are locked down. So it's our (the lieutenants) responsibility to go up on the tier and go to every door and speak to every inmate because it's not general population." (pg 24) -She did conduct a round in the SHU on August 9, 2019, sometime between 5 pm and 8 pm, and recalled going to every tier. (Pg 29) -Epstein was not in his cell when she conducted her round in the SHU because Epstein always did "open to close" in Attorney Conference, which would have placed him back in the SHU around 8 pm. (Page 31/32) -O said that the SHU staff didn't tell her about Epstein's requirement, but if they knew, they should have informed her during her shift. said the OIC should have told her. (Page 92-95) -Agent note: didn't know at the time. -If and knew of Epstein's cellmate requirement, they should have notified the Ops LT ( ) during their shift. (Page 98-100) -"If he required a cellmate, and it's a special case, then everyone knows that the phone should be ringing. But if it's just a regular inmate. Somebody got bailed out. It's not that big of a deal." If they did the 10 pm count and noticed that Epstein was without a cellmate, they should have called the Ops LT. (Page 104) -I get paid to count inmates. If I'm not counting inmates, I should just stay home. Counts are the primary reason why we are correctional Officers. It is to account for inmates. Rounds are absolutely equally important. (Page 124/125) — worked from 11 am to 7 pm as the duty officer. -Escorted Epstein back to SHU between 6:45 and 7 pm, placing him in the shower area off G tier to make a phone call. Left him there with TO, and J. from Internal, who assisted with the escort. Placed the call at 7 pm, then left. (pg 22 and 38) -Not there when Epstein was placed in his cell, but knew he was without a cellmate, but thought he was at court. (pg 78) could have done more harm then good when he went in the room by himself and took Epstein down. (Page 112 —115) Page 115 - 116: EFTA00141167 MR. Did you ever hear anything about, like, letting one inmate's cell door open, while also letting Epstein's cell open -- MR.-: No. MR. -- so that -- MR.-: No. MR. -- anything like that -? MR. : No. MR. Okay. MR. : Have I heard it in the BOP? Yes. In my 27 years. But in Epstein's case, no. MR. Okay. So, that's never been a rumor that you've heard, that another inmate actually is the one that harmed Epstein? MR. : I mean, you hear it, not in the BOP, you hear it on the outside. I never heard it on the BOP. Never heard staff, you know, speculating that. Never. J. August 9, 2019 he was Senior Officer Specialist, worked 4pm to midnight on August 9 as Internal. (page 10) Cause of death Page 31: Epstein killed himself. Pg 88-89: Didn't remember if it was him or his partner who escorted Epstein back to the SHU on Aug 9. Page 127: Didn't know of anyone trying to harm Epstein, and believed Epstein killed himself. First attempt Pg 15: Responded to July 23rd incident, Saw Epstein with sheet tied around his neck, took it off Epstein's neck and started doing CPR, Epstein was breathing Pg 16: slept on the floor due to back issues Pg 17: Tied sheet from ladder and tried to cannonball and possibly landed on woke up and called for assistance Pg 21: Epstein wanted to be cellmate with again. was moving Epstein after coming off suicide watch and Epstein asked why Epstein could not be paired up with again. Page 22: was trying to beat a murder case. It doesn't make sense that he would have tried to harm Epstein if he was trying to beat his case. It doesn't add up. (Worked in 10S and visited the SHU — FBI 302) had worked a 12pm-8pm shift the previous day, had a four-hour break, and then started the overtime shift of 12a-8a. Unit 10 South is a completely locked down unit where the Corrections Officer is alone in the unit. -Officer relieved at some point during the shift to give him a break. Lieutenant came by at some point to check on however, didn't remember the exact time. was in 10 South when the call came over, referring to when EPSTEIN was found unresponsive in his cell. EFTA00141168 stated that he was shocked that this had happened, referring to EPSTEIN's death. said that EPSTEIN was supposed to be watched more closely and that the rounds should have been conducted regardless of whether EPSTEIN had previously been on suicide watch or not. (Ops LT on duty from 10 pm to 6 am — departed at 9:30 am) First interview: Page 49-50: She responded to Epstein's first attempted suicide on July 23. CO was assigned to watch Epstein while he was on suicide watch. Page 90: "We are not required to go to each individual cell and look at the inmates. When we make rounds, we get with the officers." Page 102: Conducted her round in the SHU on Aug 10 at approximately 4 am, went up to 10 South, and then back down to the SHU because she needed to sign the round sheets. Page 119: Said Epstein committed suicide. Page 164 —167: Spoke with Epstein after the first attempt. Epstein never told her that his cellmate tried to harm him, and no proof that anyone tried to harm him. Page 170: Every inmate had the ability to harm themselves at any time. It just wasn't about Epstein. And staff are responsible for every inmate housed within the MCC. Second interview: Page 8-13: Shift started on August 9t1 at 10 pm and ended on August 10 at 6 am. Was relieved at 5:30 am. From 5:30 am to 7 am worked on finishing up paperwork for her shift. Probably working on the Daily Activities Report and LT Log. Possibly a 583 packet — couldn't recall. Went to the SHU around 7 am to help with the feeding. Believed was also helping with the feeding. was there, but not helping with feeding. had been feeding by himself. They were on the same range feeding together. Believed left around the time they were finishing up feeding. 79-80: SSA asked about the certification at 5:21 saying that she conducted a round in the SHU. Said, "I was not required to go into the ranges and check on the inmates in the ranges." Page 81-82: Said it was her signature on the 30 minute round sheet saying she conducted a round in the SHU. She claimed, "That meant that I went and I visited the SHU." "I don't conduct rounds in any unit. I mean I go, I visit with the officers, I sign - I speak with them, make sure that they're okay. And if something occurs that requires me to go into the range and investigate it, yes, I do. Sometimes if the count was announced. There were random times when I would check the officers' count. Or I would stand at the gate and stand there while they counted or something like that. But no, there was no - there was no - nothing formal thing that we were required to make - literally make rounds in SHU." She said, "at the time, we weren't required to do that." Page 114: Did not talk to him/them about sleeping. They were not falling asleep and did not speak with them about falling asleep. Page 116: Understood that Epstein committed suicide. No info related to suspicious activity that would suggest otherwise. (responded to alarm and fed the inmates after Epstein was removed) EFTA00141169 First interview Page 85: Left on August 9'h between 2 and 3 pm. Came back on August 10 at 6 am. As soon as he came on shift, someone hit the body alarm and he responded to the Epstein matter. Page 86-87: Believed he was in the elevator with Ms. and Officer = Lt and = were there. Page 86-88: and = performed chest compressions on the stretcher on the way to the second floor. Page 88: When he first arrived, he saw picking Epstein up and people were helping him put him on the stretcher. Page 89-94: Described what he saw upon arrival and what happened. Described what was in the cell. Said Columbo was the medical staff member on scene. Page 94: Then he went to the SHU and worked there for approximately one hour. He was with Lt and Officer = Page 95-96: Fed the inmates with . The inmates were saying, "You killed him. You weren't making rounds. You killed him. You weren't making rounds. You guys got to get a new job." Page 97-98: They were saying that and = killed Epstein. They said they didn't do any rounds, they just sat there, and never came once. - Worked in SHU from August 9th at 4 pm to August 10th at 8 am. (Pg 42) Cause of death Epstein's cell was approximately 15 feet from the SHU officer's desk. No one went to Epstein's cell on August 10, 2019, during the night. No one else other than and came into the SHU. (Pg 321) No one went near Epstein's cell, and no one went in Epstein's cell. (page 324-325) Said Epstein hung himself. Believed Epstein took his own life. Do you know of anyone else being offered anything to hurt Epstein or taking his life? MS. : No Additional Info Pg. 60: Epstein got common fare food when he returned from attorney visits at 8 pm. She gave him his food on August 9th Pg 110: After Epstein's attorney conference, placed Epstein in the shower to use the phone and left. No was present when Epstein was on call. called her on phone later and told her to take the phone from Epstein because his time was up. Call possibly lasted for 20 minutes Pg 119: and were also present in Shu during this phone call. Pg 129: She left Epstein in shower area after call and went to use the bathroom on 10. When she came back he was already placed back in his cell. Pg 152: She went through each tier and conducted the 10pm count Pg 153-156: She went to Epstein cell for count, mattress was on floor, Epstein was laying on it and he put his hand up. It was typical for him to lay on the floor. She thinks he may have asked for his CPAP machine. She nodded and plugged it in for him. Pg 159&198: Control has to buzz the outer doors for anybody to gain access into the SHU. The interior doors have to be manually opened by the COs in the SHU. Pg 164: She conducted the 3am and 5am counts in 10S with the CO When she came back to SHU, CO in 10S called and said that LT said he could go get his food, so went upstairs and relieved him. Pg 169: Only and LT visited the SHU overnight. came in to conduct a round and was let in by =. Pg 324-326: When she left to assist with count, she took keys with her so no one could have came into the SHU. She had to physically open the door for anyone who came into the SHU that day. Pg 331-332: She never slept during her shift on August 9th and 10. She stated when she was at the desk not moving, she was on the computer. She then stated that she worked 5 days of overtime and she would doze off, however, she caught herself and never slept. EFTA00141171 Pg 352-355: On the morning on August 10th, was doing the feeding, she opened the grill for the tier and was standing by it. knocked on Epstein's door and did not get a response. opened the door and went in. She heard call out get the cutter. She heard rip something, laid him down and began cpr. Within seconds of calling out for cutter, hit the body alarm. She recalls saying "Breathe, Epstein, breathe" and "We're going to be in so much trouble". She stood at the grill and never went in. She stated she did not see anything that was going on in there. Pg 362: She was only a foot away from Epstein cell but she never looked in during the emergency. She did not get the cutter because didn't need it. She based that on the ripping sounds she heard. She again stated multiple times that she did not look into the cell or go into the cell. Pg 365-368: She stated she saw lifting him from under his arms and dragging him back out of the corner and laying him down to perform CPR. Did not hear or see Epstein's body hit the floor. performed only chest compressions. Did not see checking for breath or pulse. Pg 372-377: She never saw where Epstein was hanging. Epstein did not have a shirt on. When she saw him, he did not have anything around his neck. He looked blue. Epstein's cell door was locked, she recalls using the key to open it. She does not recall which COs responded for the body alarm Pg 421: When she did 10pm count she knew Epsetin was in the cell by himself. — (worked the midnight to 8 am shift on both August 9th and 10th ) Cause of Death Page 189: You could see Epstein's cell door from the Officers Station. But you couldn't see inside the cell from the Officers Station. Page 191-193: Didn't see anyone, neither inmates nor staff members, go inside Epstein's cell during his shift on August 10, 2019, from 12 am until approximately 6:33 am. Said he was present in the SHU for his entire shift. Said he would have known if someone went into Epstein's cell. Again said that no one went into his cell. Page 224: Described what he saw when he entered the cell. Said Epstein was hanging from a sheet by his bed. Page 225-243: He was shown pictures and described exactly how Epstein was found and what actions he took. In summary, he found Epstein hanging from orange strings from a sheet or a shirt from the top portion of the bunkbed with his butt about an inch to an inch and a half off the floor. Epstein didn't look discolored or very different from when he was alive. immediately ripped the sheet and Epstein fell to his butt. then lowered Epstein's body to the floor and began chest compressions (did not provide breaths) for about one minute until others arrived. He was unaware if he was dead or alive and never checked for a pulse prior to the chest compressions. He did not believe he was breathing so he started chest compressions. When the other staff arrived they hooked Epstein up to the AED. The doctor and medical staff were also there and they took over. Page 259-262: Believed Epstein took his own life. No one took Epstein's life, and no one assisted in taking his life. did not take Epstein's life, or assist with taking his life. did not take Epstein's life, or assist with taking his life. Had no part in his death Page 303: It's not possible for anyone to have visited the SHU without knowledge because he and MI would have had to let them in. EFTA00141172 Additional Info Page 116-117: He replaced in the SHU on August 10". Page 118-119: Talked about visitors to the SHU. Was sure Ops LT visited, but couldn't recall specifically. Didn't recall anyone else. 119-122: Process of getting in and out of the SHU and someone within the SHU had to allow entry. Page 127-128: Either or M I were with during her entire visit. Couldn't recall if ever approached Epstein's door and didn't recall conversing with about Epstein. Page 196: Said he recalled "dozing off from here and there" during his shift on August 10. Did not know if slept. Page 214-216: Discuses being the one to discover Epstein when he was feeding the inmates breakfast. Said he said he knocked on the door, saw Epstein through the window, said "come to the door, come to the door," he didn't move, so he went in the cell and saw him hanging. He then immediately called the medical emergency. That is, he yelled for to get help and call the medical emergency. Page 217: It couldn't have taken more than 30 seconds to call for the medical emergency after first saw Epstein. Page 219: last saw Epstein the day prior, on August 9, around 6:30 am, when he fed him breakfast during his shift. Page 252-253: assisted with bringing Epstein down to the second floor Page 298: MR. : Alright. But there's no-. You were there and there's no way that anyone could have accessed the SHU aside from - MR. Yeah, nobody -. MR. or you allowing them to get in? MR. To allow them to get in. Yeah. MR. Okay. And you said Epstein's cell was locked when you — MR. Yes. Page 301-302 MR. : Okay. Now Agent Dennis just asked you a question about could anyone have come in and out of 9 South. Out of the SHU. MR. 10 South. MR. : Out of 10 South, but out of the SHU. If you were sleeping -- MR. Mm-hmm. MR. : -- is it possible someone could knowing if you were sleeping? MR. No. MR. : Because you would have to let them in? MR. I would have to let them in. MR. : Is there any other way they could have got in without you letting them in? MR. No. MR. : Could someone else have a key that they could have used? MR. It would have to come from control. Keys are in - the only other keys are in control. MR. : So the only other key is in the control? MR. Yes. have came on to the - into the SHU and left without you EFTA00141173 July 23'd attempt Page 43-44: was assigned to watch Epstein on July 23, 2019, for 6 hours while he was first placed on suicide watch and communicated with him during that time. (On Page 81, he said it was during morning watch — from 1:30 am until about 8 am.) Page 49-50: Was aware that inmate was Epstein's cellmate on the day when Epstein first attempted suicide. Page 51-53: and another officer are the staff members who responded to Epstein's suicide attempt in the SHU. was working internal that day and wasn't the first officer to arrive. When he arrived, Epstein was being brought out of his cell and being brought down to the suicide watch area. Page 53-57: Recalled Epstein saying that attempted to beat Epstein up, but couldn't remember the exact details of what Epstein had said. Said he made the statements down in the suicide watch room when they took his clothes off. Said that CO Clark was also there. He also said it to an LT when he was in his cell. did not believe Epstein's statements to be truthful. EFTA00141174
