All,
Just want to make sure we're all on the same page after some calls yesterday. Sorry for the long email
SDNY agrees that we'll lead the forfeiture investigation and CART exam but they (using an outside vendor) will
lead the financial analysis.
CART: We have OT approved for this weekend so CART is working to image all digital devices. Once we
determine the scope of data, we'll have further discussions with SDNY re the use of FTK or Relativity. FYSA -
They agree Relativity isn't good for image analysis but they're inclined to use Relativity for documents, emails,
etc.
FORFEITURE: M, you said your folks had already done some work on this. Obviously we'll need your team to
coordinate with the case team and AUSAs. Thank you for your support.
FINANCIAL ANALYSIS: SDNY used an outside vendor on previous high profile cases so I thought that giving this
to them was an appropriate compromise considering all the other issues we've had.
and I spoke about
this and he understands this isn't meant to be any statement against
or his team. I think the
documentation here is easy as the analyst will just throw everything in the FF subfile.
Over the past few days I've had conversations with
about potential evidence on JE's island. Considering
what we have already (victim statements, open source reporting, seized images in NY) I thought we might have
PC for a S/W. I spoke to CEOS and we might have it. They're going to talk more on Monday morning and get
back to me. Yesterday evening I mentioned this to SDNY who said they were going to discuss it. They agreed
we should be searching the island if we're assured of the PC.
CP CHARGE:
and I also discussed this yesterday.
mentioned there were some images (#
unkown) that may represent a lascivious display of the genitals. Considering the pictures/paintings in the
residence and his masturbation while laying next to minors in various stages of undress, I've pressed CEOS for
their thoughts on a possible CP charge based on some of the full frontal images.
RESOURCES:
and ....As we've talked about, please keep me posted on any needs you may have. SAC
has been
fully supportive of our requests for OT and ASAC Casale assured me he'll surge additional bodies to the
forfeiture investigation if needed. There are many tentacles to the investigation which are all pushing forward
simultaneously. I want to make sure
and
don't get overwhelmed especially as they spend more
time down in Florida and are off the grid.

VICTIM SERVICES:
and I had a good conversation about the importance of tracking and servicing our victims (current total is
59). I think you all know this is of the highest priorities for me. I will tell you I've received calls from outside the
FBI from some people who are concerned about this very issue. The case team must ensure they are over
communicating with our VS(s), and/or VSD to ensure we have a VS at every victim interview and they should be
on standby when we're interviewing someone who MAY be a victim. UC
....I heard we have a VS in Florida
who is traveling 2 hours each way for our victim interviews.
and =are planning a week long trip to
Flordia which will include some victim interviews. It might be appropriate to have a VS spend several days with
the case team depending on the scheduled interviews.
TO DO:
- Can I get answers to #1 and #2 early Monday.
1. Can you find out approximately how many images
thought might constitute CP? Are we talking
less than 10? 100s? An estimate is fine.
2. Re the binders found in the closet
Were any of the names on the binders of MM based victims or were
they only of the NY based victims? Were you able to tell where any of the images were shot? Do any of
the images show JE touching the breasts of minors?
3. Please work with
to ensure a clear process is established to ensure all of the subpoenas, data
returns, and analytical results of the financial analysis are included in the file.
I greatly appreciate everyone's support and work on this important case.
