CASE BACKGROUND Narrative: The FBI's New Hampshire Safe Streets Gang Task Force (NHSSGTF) is in direct support of the New York Field Office (NYFO) in order to locate and arrest GHISLAINE MAXWELL. MAXWELL is known to have three separate citizenships and is considered a flight risk. On June 30, 2020, NH-2 and the NHSSGTF received information that MAXWELL maybe located in the Sutton, New Hampshire / Lake Sunapee region. MAXWELL is known to be the associate of (girlfriend of) Scott Borgerson. At time of writing Borgerson maybe a person of interest but is not an alleged subject. Once the phone is located, surveillance operations will commence to ensure MAXWELL does not leave the area. SA Chambers will coordinate with the Sutton Police Department (SPD) and ensure the SPD is aware of FBI operations. At the approval of Boston Division executive management and after briefing the safety plan, NYFO, NHSSGTF and NH-2 personnel will affect the arrest of MAXWELL. MAXWELL will be transported to MERRIMACK County Jail for a video initial appearance. MAXWELL will then be transported to the Southern District of New York via FBI or the USMS. Criminal Investigations of this type are undertaken in a dynamic environment that is likely to require Agents to adapt quickly to changing circumstances by modifying certain elements of the plan during, or just before the operation itself. Should a material change become necessary, the NH-2 SSA shall be advised of any and all operational changes. Specific contingency plans: 1. Vehicle Traffic Stops will not be conducted by NHSSGTF. Once the Federal Arrest Warrant is secured, steps will be taken to arrest MAXWELL on the street in the open. The arrest maybe affected by either a knock and talk or by securing a federal search warrant for a third-party residence; once the location of MAXWELL is determined. 2. Medical emergency: Emergency Medical Services will be contacted via local and/or state police radios and 911 as appropriate. 4. Barricaded subject: In the event of a barricaded subject, surveillance / arrest personnel will establish a perimeter and coordinate with FBI management, local police command staff, and state police command staff as appropriate. 5. Additional Contingency Plans: In the event the extraction of a LE person is warranted: LE Officers will be on stand buy and designated as a rescue element with additional officers assigned as a support/containment element. This extraction team will have first response and will approach, secure and extract the LE Officer from the scene. The support containment element will secure the perimeter and facilitate movement of the officers and the LE Officer to a secure location. Transport will be determined by the nature of the critical incident. All command and control of extraction ops will be executed at the discretion of the ON scene commander in coordination with the NH-2 SSA. THIS OPERATIONAL PLAN IS A GUIDELINE THAT WILL BE FOLLOWED UNLESS CIRCUMSTANCES AND/OR SUSPECT(S) OR SUBJECT(S) DICTATE THAT THE TEAM ALTER THE PLAN IN A SAFER MANNER. THIS DECISION WILL BE MADE DURING THE OPERATION AND WILL BE BASED ON THE INFORMATION AVAILABLE AT THE TIME. USE ATTACHMENTS AS NECESSARY. Agents may use deadly force only when necessary, that is, when the Agents have a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the Agent or to another person.
