FBI, et al. - Epstein FOIA Request Hi Just the NPA. I can't speak to how or if the document will be released. That is likely EOUSA's call. I want to confirm IF the document is released, that it won't impact any ongoing investigations. If it will impact an investigation, I would need to justify the harm, at some point. The NPA is a priority of the Plaintiff's. Thanks, From: N. (NY) (FBI) < > Sent: Tuesday, December 29, 2020 2:06 PM To: . (IMD) (FBI) < > Subject: RE: 20-cv-1527 Clemente v. FBI, et al. - Epstein FOIA Request Hey= Thanks for the heads up. Is it just the release of the NPA or are there other serials that are being released? FBI, et al. - Epstein FOIA Request Good Morning SA Plaintiff in this FOIA case has prioritized the Non-Prosecution Agreement documents. In a previous FOIA litigation (17-cv- 3956 Radar Online), we switched to 7A and lumped the NPA and the majority of the other documents pertaining to the MM case file as pending and kept the overarching 7A on those. I am not so sure that would fly with this Plaintiff, unless the NPA would truly impact your ongoing investigations surrounds Epstein and his actions. If we are able to process the NPA for release, I am not quite sure how we would tackle that yet. Would the potential release of the NPA impact any active investigations? If yes, can you articulate the harm so I can report back to our attorney If no, I'm sure this will get raised up the ranks and a lot of eyes will be on this, so I will run any potential release by you before it goes out the door.
