Paul Paul G. Cassell Ronald N. Boyce Presidential Professor of Criminal Law From: Jackie Peraek Sent: Thursday, September 19, 2013 9:27 AM To: Paul Cassell Cc: Lee, Dexter (USAFLS); Villafana, Ann Marie C. (USAFLS); Brad Edwards Subject: Re: Position on Renewed Motion for Expedited Ruling Hi Paul. The Court's August 13, 2013, order denied your motion for an expedited decision on our motion for a stay pending appeal and ordered it held in abeyance until the Court ruled on your motion to dismiss for lack of jurisdiction. The next day, the Court ordered your motion to dismiss to be carried with the case. In addition to the objections we interposed with respect to your prior motion for expedited decision on the stay issue, which we continue to assert, we also object to another motion for expedited decision on the stay issue because the Court has not yet ruled on your motion to dismiss, and has said that it will not rule on your motion for expedited decision until it does so, so we believe that another motion for expedited decision should be similarly denied. That said, however, we have both asked for oral argument, so we have no objection to the Court setting an expedited date for oral argument. --Jackie On Sep 18, 2013, at 8:26 PM, "Paul Cassell" Hi Jackie, e: Brad and I are preparing a renewed motion for an expedited ruling on the Epstein motion for a stay before the CAll. Friday we are going to file a motion for a ruling on or before September 27, 2013. I am writing to get your position on the motion. Thanks in advance for your help.
