The FBI identified two e-mail systems used by its employees: (1) the Unclassified Net (UNET), which is used to send and/or receive e-mails from outside the FBI. This would include emails from other DOJ components, other federal agencies, and other federal and/or state law enforcement agencies; and (2) the FBI Net (FBINET), which is used by FBI employees to communicate internally. The FBINET is secure and is capable of transmitting classified information. I was told that, since we were searching for older e-mails, they would not exist if the e-mail had been "double deleted," e.g., deleted from the e-mail inbox, and then deleted from the deleted items box. Also, e-mails on the FBINET were not regularly backed up until after the period specified for our search, 2006 - 2008. I asked the FBI to conduct a search of the e-mail accounts of Special Agents and the co-case agents in the Epstein criminal investigation. The search was to cover the period January 1, 2006 to December 31, 2008. I provided the FBI Information Technology section a copy of petitioners' Supplemental Request for Production to The Government Regarding Evidence of Government's Violations of Victim's Rights, dated August 25, 2016 (transmitted on August 29, 2016). I asked the FBI to design a search which would cover responsive e-mails, and told them I wanted a broad search. The FBI search yielded 246 emails on the UNET, and 1,908 on the FBINET, for Agents and email accounts. On January 18-19, 2017, and February 8, 2017, I went to the FBI Miami field office and reviewed the emails retrieved by the FBI. None of the e-mails I reviewed were responsive to Supplemental Discovery Requests 1 through 8. Specifically, I looked for e-mails expressing concern about individuals in the U.S. Attorney's Office having business, social, or other relationships with Epstein (Supp. Disc. Request No. 1), and the possible offer of future employment or client business by Epstein to members of the U.S. Attorney's Office (Supp. Dis. Request No. 2). I found none. As to Supplemental Discovery Request No. 3, there were e-mails "regarding the prosecution of the Epstein case," but none I found that pertained to prosecutors obtaining benefits from Epstein.
