POINTS OF INTEREST : • Constable Statement provided - Constable reported that a phone call was made to the Port Pine Police Department in relation to a driving offence and disorderly behaviour- Not reported within the statements as witnessed - Constables - reported that due to this phone call he was tasked to the area - I was not questioned in relation to the repo of the driving offence or the disorderly behaviour upon the arrival of Constable on the scene of the beachfront. - Did not follow correct procedure. Refer to statements Attached • Breathalyser - I was not in the vehicle or in a position to operate a vehicle. I did not refuse to blow into the Breathalyser test as I did not at anytime have time to react in a correct manner to the officers demand of " Blow in this ", as Constable aggressively charged towards me as I stood outside of the vehicle , leaning against the front guard of the vehicle rolling a cigarette as reported within the statements. I did not refuse to blow in the breathalyser test within the Port Pirie Police Department which I was informed resulted in a negative reading. Refer to statements Attached • Tasked to the area - Constabl eported that he was tasked to the area in relation to a report of a driving offence and disorderly behaviour - Constable did not witness myself within the position to operate a vehicle and did not witness the offence Driving without undue care - Wron I charged with a driving offence - Not witnessed by the arresting officer, Constabl , Port Pirie Police Department. Refer to statements Attached • In relation to Sexual Intent - Assault - Refer to statement - Jacqueline Pearce - Constable Port Pirie Police Department pressed his full body up hard against my body as he had me bent over the boot of my vehicle, as I was placed into the handcuffs - I found this to be of a sexual nature and had horrified me in relation to the additional information of which I have supplied. • In relation to Sexual Intent - Assault - When being questioned in the Port Pirie Police Station in relation to the charges after the officers had removed my clothing and personal items I was asked the question -" What have you got on under that dress ? "- I had found this line of questioning very inappropriate and held no relevance to the charges in question and viewed it with sexual intent which had made me feel very fearful of the attending officers and their intent. • In relation to Sexual Intent - Assault - The attending officers then proceeded to conduct an internal search of my person of which I found very inappropriate and held no relevance to the charges placed against myself and I felt fearful of the attending officers intent. Police Involvement - Refer to Documents - Police Involvement - Targeting - 2007 - 2009 - 2013-2016 In relation to the disc - Evidence supplied by the Port Pirie Police Department - Requested by representing lawyer - Lachlan McAuliffe - Video footage dearly shows that upon the arrival of the officers on the scene of the beachfront - I was not in the vehicle or in a position to operate a vehicle. • In relation to the disc - Evidence supplied by the Port Pirie Police Department - requested by representing lawyer - Lachlan McAuliffe - I was informed that my arrest was in relation to refusing to supply personal details - I was not informed or questioned upon the arrival of the officers upon the scene of the beachfront as to why they had anived on the beachfront as I stood watching fireworks - Cars in place on the beachfront - I was visibly standing outside of the vehicle in question and was not informed of the reason of the officers attendance as is visible I was not causing a disruption or behaving with disorderly behaviour or driving without undue care as states within the reported offences. • In relation to the disc - evidence supplied by the Port Pirie Police Department - Requested by representing lawyer - Lachlan McAuliffe - I was not read my rights upon my arrest upon the beach as I was placed into handcuffs and led towards the accompanying police vehicle - Paddy wagon. I was informed that my arrest was due to not supplying personal details not refusing to blow into a breathalyser test. I was dearly stating and questioning the reason for the arrival of the officers on the beachfront - The attending officers would not supply this information and refused to do so upon continuous questioning within the Port Pirie Police station. In relation to the disc - Evidence supplied by the Port Pire Police Station - Requested by representing lawyer - Lachlan McAuliffe - I refused to give anymore details or to comply with the directions of the officers in relation to my request of having a lawyer present - Port Pirie Police Station. • In relation to the disc - Evidence supplied by the Port Ririe Police Department - Requested by representing lawyer Lachlan McAuliffe - I am dearly complaining of the injuries suffered by the officers aggressiveness of the apprehension of the arrest - Shoulder and face Having my face slammed down onto the boot of the car I deemed inappropriate behaviour of which I had found to be very aggressive and fearful in relation to the police involvement. a EFTA00266476 In relation to these charges i am requesting that charges be placed against Constable Port Pirie Police Station based on the grounds of the following : • - Wrongful arrest - Not following procedure - Tasked to the area • Causing bodily harm - Physical Assault - which resulted in a Permanent injury to the right shoulder joint - Refer Medical records - Certificates - Diagnosis • Wrongful suspension of licence over a twelve month period - .inmobilisation - Which resulted in hardship and inconvenience while suffering from a Permanent injury and physical pain - I was not in a position to operate a vehicle when th of blow into the breathalyser test was commanded by the officer - Constable Port Pine Police Department. I had found this action to be fearful of the officers intent and inappropriate behaviour while a female was handcuffed in the back seat of the vehicle - In question - Intent - Sexual Port Pine Police Department - Upon my arrest the two male officers had aggressively slammed me forward down onto the bonnet of the police vehicle as the two officers pressed their bodies hard up against the full length of my body while placing me into handcuffs and bent over the bonnet. - Internal search - The attending police officer ( female ) proceeded to conduct an internal search of my person which I had found to be inappropriate and irrelevant to the charges placed against myself - I found this to be very intimidating and fearful on the grounds of sexual intent. In particular you raise two instances where police took action against you in relation to driving with the prescribed concentration of alcohol in your blood. You also complain about your arrest on two occasions: 13 August 2015 and 5 February 2016, taking issue with the charges laid against you and the police account of events. Oi^ I advise that from the information you provide, it appears the police officers involved in the ;incidents have engaged in routine police procedures in relation to their contact with you. This includes conducting random breath tests, responding to reports from the public, making an arrest based on a reasonable suspicion of an offence, compliance with custody procedures in relation to searches and use of cells. In my view there is no evidence of police misconduct in relation to the concerns you raise. In relation to your complaint that the charges against you have no merit and your request to be supplied with evidence, these are issues that need to be addressed through the court process. In other words, if you dispute the charges, you will need to do so in court. This office does not become involved in matters which are before the court. I have therefore made a determination pursuant to section 21(1)(d) of the Police (Complaints and Disciplinary Proceedings) Act 1985, not to refer your complaint for investigation, as in my view it would be unlikely to reveal evidence of misconduct on the pad of a police officer and therefore such investigation is unjustifiable. During the closed court hearing conducted via video link, Port Pine Courthouse - 11 / 03 / 2016 - I was denied the lifting of the 12 month suspension of my licence and was informed by the Magistrate to complete an application to have my licence re— instated within the Port Pine Fines Department and was quoted the amount of 5256.00 for the application to be processed. I am requesting a thorough investigation be applied into the reported incidents and the consideration of the re - instatement of my licence be investigated and the 12 month suspension lifted, charges placed against myself by the Port Pine Police Department be withdrawn and all documented personal evidence, DNA, fingerprints and photographs be removed from the system and the first and second charges be re - opened and investigated which have incurred in fines, in relation to the reported information of which I have supplied.
