JACOBS was with friends doing some photography when she obs creed a maroon MITSUBISHI sedan, SA Registration riving towards her and the group she was with. JACOBS watched as the sedan drove towards them at speed. JACOBS didn't know what speed it was travelling at but thought it was going so fast it wee going .to hit her and the group. JACOBS states that the car braked heavily end turned, stopping about ten (10) metres away from her. The car was being driven in a very erratic manner. JACOBS observed that the driver of the sedan was a female, wearing a blue dress with alga heels and blonde hair end that she was the only occupant of the vehicle. JACOBS saw that she exited from the driver's seat. JACOBS further states that she could hear the female talking but could not see anyone else with her, she wasn't sure if the female was talking to herself or not. POLICE Count 2 At about 9,07 pm on Thursday 17th August 2015, Police as on mobile uniform patrol when tasked to a Driver Under the Influence n an area of PORT PIRIE known as "The Bridge to'Nowhere" on the John Pirie Island. The tasking was for a drunk female driving a maroon MITSUBISHI Magna, SA Registration and that the driver had almost been involved in an accident. On arrival Police in a marked police vehicle located the motor vehicle in question, a maroon MITSUBISHI sedan, SA Registration parked facing north on the beach front about 50 metres away from the Jetty area, ;3( observed a female seated in the driver's neat of the sedan and exit the Oa le to be standing next to the driver's door on exiting his vehicle. approached the female who was wearing a blue dress and high heels attempting to roll a cigarette. activated his personal body worn camera and approache smile holding an Alcotest device in his hand. The female flat out re used. The female was informed that if she did not provide her detail. she could be arrested. Her reply was "Arrest me". When warned again the female replied "Yep, Arrest me, put me in handcuffs if you fucking want to, POCK YOU". On three more occasions the female was asked to provide police with her personal details. The female refused three more times end was subsequently arrested at 9:10 pm. Count 3 The female wee informed she was under arrest and told to put her hands behind her back. The female instantly resisted police by gripping her hands together and cro ..... forwards. Her hands were clenched tightly and close to her stomach. told the female to stop resisting on eight (8) occasions and to put her hands behind her back on ten (10) occasions. The task of placing the handcuffs on the female was made considerably harder by her physical resistance end non-compliance with verbal commands. At 9,13 pm further Port Pirie General Patrols arrived and provided assistance fn conveying to female back to the Port Pirie Police Station. Prior to departing the female provided me with the name of "Jacqueline". At about 9,20 I approached a group of people about 50 metres away from the arrest location and obtained witness details from Kathy JACOBS, the witness in this matter. Registration checks on the vehicle confirmed that the sedan was registered to a female by the name of Jacqueline Carol PEARCE, the accused in this matter, of a PORT PIRIE address. Count 4 At about 9,49 pm, Police activated an audio voice recorder. directed the accused to submit to an Alcotest as he believed she was the driver of the sedan. The accused refused to submit to the Alcotest. commenced a PD207 - Oral Advice on Refusal or Failure to Comply with a direction in relation to an Alcotest. The accused was again directed to submit to an Alcotest. The accused again refused. The accused was provided with her rights in relation to the taking of "Good Cause" blood. The accused refused this right. The accused vas cautioned prior to further questioning on the PD207. As a result of this tasking I arrested a female by the name of Jacqueline Carol PEARCE. 5. On my arrival I observed a maroon MITSUBISHI sedan parked facing the beach and foreshore area. PEARCE was initially seated in the arlver's seat but exited the seat when she saw the police car arrive. The ignition was on but the engine was off. The stereo system fitted to the car was on and playing loud music. I turned the vehicle off which turned off the music in the car. I secured the keys that were located in the ignition to my key clip on my work belt. The key was a single MITSUBISHI car key with a black tag attached. 7. At the time of her arrest, PEARCE was holding in her hand a can of "Wild Turkey" bourbon and a cigarette. PEARCE smelt strongly of intoxicating liquor during my dealings with her. 8. A bag was located inside the vehicle which was conveyed with PEARCE to the Port Pirie Police Station. 9. At the Port Pirie Police Station, PEARCE identified herself as Jacqueline Carol PEARCE to the charging Sergeant, Sergeant 10. PEARCE refused to submit to an Alcotest. She was issued with a twelve month instant loss of licence which she refused to sign. The keys that were taken from the ignition of her vehicle were booked into her property and returned to her on being bailed. All the property that was booked onto the SHIELD property section was signed for as belonging to PEARCE by PEARCE. This included the contents of the bag that was removed from the vehicle and the car key. The female was being argumentative and was not listening to the police who were standing with her. 7. I was asked bye if I could assist with searching the female as she was under arrest. I asked the female her name, she initially would not state, however she eventually stated her name was Jacqueline. I searched the female at the rear of the cage vehicle. During this time I noticed that the female smelt strongly of liquor and her eyes were very glassy. I formed the opinion that the female was intoxicated. 8. and I conveyed Jacqueline to the PORT PIRIE Police Station cell complex where she was escorted inside. and I remained with Jaqueline until arrived at the cells. 9. Zac and I had encountered conflict, in our interaction, as Zac had made a derogative remark, which I had found very unusual, insulting and degrading. Comment : " You make the most money lying on my back in bed" , and a reference to prostitution. I had stopped my interaction with Zac on this occasion and had blocked his phone number from connecting with mine via text messages or phone call contact. I was still in interactions with Paul Gardner at this time but the relationship had become one of a volatile nature which had caused confusion and fear within my mind, which had resulted in an affair of disconnection of interaction on numerous occasions over a ten month period. The relationship of which I had been sharing with Paul Gardner had again ceased in contact and I had unblocked the phone number of Zac, under the suspicion that the incidents that were occurring around me were related in some way. On the day that I had unblocked Zac's phone number on my mobile phone, within an hour, I received a text message from Zac, re-instating our contact and our shared conversations from our previous contacts. After a long period of continual deep thinking in regards to the events that had been unfolding within my life over a five year period, the suspicious behaviour and the unusual activity began to make sense and I began to believe that I had been a target of an illegal activity of sexual intent within this local region, concerning prominent positions and police involvement. I began to believe that the targeting was one of a pre— meditated , well orchestrated conspiracy to entrap myself and my children, including my immediate family, into a life of prostitution. I began to become quite fearful and my mind began to race with panic and fear, as the fear overwhelmed me that my children had been hurt or assaulted in the same way of the targeted assault that had been applied upon myself. Due to the numerous amounts of unusual behaviour and activities that had surrounded myself and my family. I had sort the company of a friend that day in my need for comfort and to talk about these issues that I had held in great concern within my mind. EFTA00266606 2 After consuming a glass of wine and one can of Wild Turkey , pre-mixed bourbon, that I had purchased to share with my girlfriend that afternoon, I gathered my belongings - handbag, cigarettes and the three cans of bourbon that had remained within the cardboard holder from the purchase of the alcohol, and left the residence about seven pm that evening. I then drove to the local beach ramp site carpark, in Port Pirie, and parked my vehicle facing the waters edge, close to the " Bridge to Nowhere ". I sat in in the front drivers seat, over looking the water and the John Pirie Island from across the water, feeling very nervous, fearful and confused, as I smoked a cigarette and continued to ponder over all the details of information and events that had surrounded myself and my family in the previous years leading up to this evening. I had become very confused and now feared that the continual sexual advances that I had been receiving over a five year period from unknown, unusual sources, and the attention that had surrounded myself, my children and my immediate family from numerous male and female officers, business owners, medical experts, men from within prominent positions and members of the local public ,had been a pre - meditated sexual attack to form a image of deformation upon myself and my children. I started to cry, placing my head into my hands as I sat in the front seat drivers side of my vehicle, confused, upset and bewildered to the reason behind these occurrences, and as was trying to come to a decision as what to do, as I felt that I could not report this to the local police department as I feared their involvement in the sexual advances that I had been receiving over a long period of time. I had come to the conclusion that Zac ( the alleged Police officer that I had been speaking to ), was in some way involved in this sexual attack upon myself and my family and I had become suspicious that Zac was in fact impersonating a police officer and was not the person of whom he had claimed to be. ( Plenty of Fish - online dating site - first contact of our interaction ) I sent Zac a text message via my mobile phone, underlining and stating ( a clear message of the understanding that I was not impressed with being treated this way and made it very clear to him that I did not wish for him to make any contact with me in the future. ( a defensive message ). I sent this message at eight pm that evening ( phone record ) Last contact with Zac - 14th August 2015, ( phone record ) After sending the message, I placed the mobile phone into my vehicles central console and lit up another cigarette, as I continued to look over the water towards the John Pirie Island. As I sat smoking my cigarette , I noticed a spectacle of coloured, flickering lights spinning in the evenings darkened skies, coming from the direction of the John Pirie Island beachfront. " What's that ? ", I commented to myself , as I continued to finish my cigarette and watch the flickering lights in the darkened sky. I butted out my cigarette in the vehicles ashtray and started the engine of my vehicle and drove over to the entrance of the " Bridge to Nowhere ". EFTA00266607 2 I stopped at the red traffic lights at the entrance to the bridge and entered the bridges upon the changing colour of the traffic lights at the speed indicated on the bridge sign post. I followed the road that led onto the gravelled road that directed you to the waters Beachfront, noticing campers, a tent and a four wheel drive to my right, situated just after the bitumen road area, and continued to amble slowly down onto the beachfront towards the flickering lights, that I could now see were a string of fireworks, connected to a cable or rope of some type, being swung around in a circle above a mans head. ( Ernie Polly ) and a film crew recording on a tri - pod about 50 metres away from the position of the man, standing on the waters edge in front of the first red tower situated in the water. I parked the car facing side onto the film crew and the group of vehicles, about 50 metres distance away, but in direct line with the first red tower and the man ( Ernie Polly ), swinging the fireworks around above his head. I exited the vehicle via the drivers side door, leaving the radio playing ( Magic FM ) and the drivers door open as I stood against the front drivers side front guard of the vehicle. ( Rego : ). I had left the drivers side door open, as I was listening to the music and singing quietly, trying to ease my mind from the events of the day. I opened the can of coke that my friend had given me to drink instead of the alcohol, as I was driving. I continued to listen to the music while I watched the film crew filming the fireworks display being swung around on the cable. I did not know these people- film crew or the man. As I stood watching the display, the man ( Ernie Polly ) stopped swinging the fireworks display above his head and walked diagonally towards the film crew and they spoke quietly to each other. ( I was not close enough to hear one word of this conversation. ) After speaking for a moment to the woman ( Kathy Jacobs ) the man ( Ernie Polly ), started to walk towards my direction with the fireworks cable in his hands. As he approached and had entered into my ear shot ( hearing distance ), I called out to the man ( Ernie Polly ), asking if it was okay for me to stand and watch the display. The man ( Ernie Polly ) replied instantly in a friendly manner, " Yes, as long as you don't get in the way ", and proceeded to walk back over to the waters edge of which he had been standing previously in front of the first red tower in situated in the water, and continued with the activities, as I watched quietly, leaning against the front drivers side guard of my vehicle. After standing in that position for close to an hour, watching the fireworks display on the waterfront, the man ( Ernie Polly ) and the film crew packed up the film equipment and fireworks display and packed them into their vehicles and left the area. ( about three cars - one was white ). I continued to stand next to my vehicles front drivers side guard and proceeded to roll a cigarette as I finished the warm can of coke that I had been sipping while watching the display. As I stood rolling the cigarette, listening to the radio alone and now in isolation on the beach front, a police vehicle rushed upon the scene, driving at a very fast speed EFTA00266608 4 slid onto the scene in the gravel and beach sand, about ten metres away from my parked position on the beach, billowing a screen of dust and gravel into the air as the police vehicle came to a sliding halt. A police officer leapt from out of the drivers side seating of the vehicle and rushed aggressively towards me, standing next to my vehicle, holding out in front of him at arms length distance a breathalyser testin unit and angrily demanded, " Blow in this ". As the police officer ( Constable ) rushed aggressively towards me, I started to panic ( as my mind raced in regards to the previous thoughts and conclusions of the suspicious activity that had been surrounding me for a long time ), and feared for my life of a physical or sexual attack, as I had been receiving death threats and threats of violence from an unknown source. I dropped the can of coke from out of my hand, that spilt down the front of my dress and rolled under the front of my vehicle and my cigarettes fell onto the bonnet of my vehicle, as I raised my hands up above my face, flat palms facing towards the police officer ( Constable =MI ), in a surrendering position as I said the words, " No, whoa, What is going on ? ", In a panicked voice. The officer ( Constable ) grabbed my arms aggressively and aggressively slid me down the length of rrrte•and up against the drivers side back panel at the back end of my vehicle. " What are you doing ? ", I cried out, fearful and panicked, as the officer aggressively grabbed my arms, forcing them behind my back, hurting my left and right shoulders, wrists and arms severely as he roughly placed my hands into the very tight handcuffs, as he shoved his other hand, that was not holding my hands in the hand cuffs, to the base of my skull and slammed my face down hard against the boot panel of my vehicle, resulting in an instant swelling and bruising of my left cheek bone. " What is going on ? ", I cried out again to the police officer, as I raised my face up from off of the boot panel. " Your under arrest for resisting an officer ", Constable replied, as he stood holding me against my vehicle in the handcuffs pressin weight up against the full length of my body. As I raised my face up off from off the boot of my vehicle I noticed that three other police vehicles had arrived on the scene and the police had opened the back of the paddy wagon police vehicle in preparation to place me inside the back department of this vehicle. I panicked in terror as the other male officers ( about 6 ) formed a half circle around me, from the position of Constable police vehicle to the paddy wagon and stood in an intimidating manner around me. Constable moved me from off of the back of my vehicle and stood me next to a female officer ( dark short hair, with black rimmed glasses, modern style , younger officer ) , that had arrived on the scene. I stepped back behind the female officer, handcuffs on my wrists and started to cry in terror, panic and started to plead with her through my tears, " Please don't let them put me in there ". " Oh god, please don't let them put me in there ", pleading and begging the female officer. ( motioning towards the opened paddy wagon police vehicle ). The female officer talked to me calmly, trying to console my fears before stepping towards Constable and having a private conversation with him. The female officer returned to the position of which I was standing (about two arms length distance away from her ) , and informed me that she would place me into the back seat of the EFTA00266609 5 police vehicle, which the female officer proceeded to do. I was left sitting in the back seat of the police vehicle for about ten minutes while the other police officers spoke to one another. A male officer returned to the police vehicle that I was sitting in, closed the back door of the police vehicle and proceeded to escort me back to the local Port Pirie Police Station. As we drove along the gravelled section towards the " Bridge to Nowhere ", the male officer whom was driving the police vehicle shone his torch on the campers that I had seen upon my entry into the area, but continued to drive the police vehicle towards the " Bridge to Nowhere ". When we arrived at the Port Pirie Police Station , I was escorted from the police vehicle by the accompanying officer to the back section of the Port Pine Police Station where the cells are. I had not been in this section of the police station before and felt very fearful and confused as to the police officers intent and of why I had been arrested in the first place as it had not been explained to me apart from resisting arrest and refusing to blow in the alco test. I felt very nervous, confused, fearful and untrusting of the male officers and of the situation of which I now stood. ( sexual advances, police involvement in numerous unexplained incidents. ) I was led towards a counter that had a glass panel in the front of it, an open door on the left hand side of the room, a computer and computer screen on the right hand side of the counter, and a window (venetian covered - closed ) and a door at the back of the office area. It had looked to me like an open office cubicle. I asked if I was able to use the lavatory. The officer said yes and led me to this section before leading me back out to the open office cubicle where I was then stripped down of my black, short length jacket, stiletto heels, anklet bracelet and my belongings ( handbag ), and was left standing in only my tight fitting dress. I kept asking the female and male officers that stood around in numerous amounts around me - " Why have I been arrested for standing on a beach watching fireworks ? ", but kept on receiving the same reply, " For resisting arrest ". I kept asking the same question as my mind could not fathom the reason for their arrival on the scene of the beach in the first place apart from the sexual advances and the continual police harassment that I had been receiving over a very long period of time. The police officers would not give me an explanation or ignoring my questions with silence. I started to explain and complain that I was experiencing and suffering from a lot of pain in the region of my right shoulder to which I was presented with an icepack which I held against the pain in my right shoulder for the whole duration of the period spent at the police station. My wrists that had been aggressively forced into the very tight handcuffs had begun to bruise and swell to double their size and my movement in this area had began to become constricted due to the enormous amounts of swelling and bruising. I was beginning to display bruising and swelling down the lengths of my wrists to my shoulders amongst the red abrasions and fingerprint marks wrapped around the skin of my arms. ( Photos taken on the night - mobile phone- accidently deleted ) I kept repeating my questions of why had I been arrested for standing on a beach outside of my vehicle, as I had not caused any trouble or disturbances to any member of the EFTA00266610 public or destruction of any public property. " You know why you are here ", a male officer and a female officer replied. ' No I don't ", I answered, confused and fearful. At no time was I read my rights or had it been explained to me as to why the officers had arrested me or why they had come to the beachfront in the first place. I kept asking when explained to me " Resisting arrest ", " But why was I arrested in the first place ", " What did I do ? ". As the numerous police officers including Constable stood around me, coming in and out of the door at the back entrance to the open office cubicle area I over heard one of the officers mention the name " Roger ", and also a local member of parliament before proceeding to ask the question ' So what have you got on under that dress ? " I looked at the police officer very concerned and fearful of the comment ( sexual intent ), as I found the comment to be very sexually intrusive / invasive and an inappropriate line of questioning considering the charges and circumstances of which I had found myself in their custody. The dress that I was wearing on that evening was very tight fitting - elasticised and was very obvious that I could not hide or fit anything under that dress apart from the underwear of which I was wearing. I felt very fearful of their intentions and untrusting of the circumstances of which I was standing. ' I want to make a phone call ", I said, looking at the female officer ( older woman, dark , short hair- shoulder length hair, glasses ). " I am dating a police officer, his name is Zac ", I ex lained to Constable " Well do you want to ring Zac then ", Constable replied sarcastically , sniggering at me smugly. I had felt then that this arr w rt of a sinister planed attack upon myself and my family and that Constable had a close personal interaction with the officer that I was seeing, Zac and had planned this attack together that night after I had broken of the interaction with Zac that nigh, about an hour earlier - Phone records supplied. I became very fearful, anxious and confused and started to once again panic. My fears of the outcome of the night were in regards to my physical wellbeing. " I'm not answering anything with out a lawyer present ", I said, asking for my phone call again. The female officer who stood behind the glassed panel of the cubicle handed me the hand set of the phone and proceeded to dial the number for me of my next door neighbour , Val Stevens, and I began to explain to Val that I had been arrested and was in the Port Pine police station and I was very confused as to why I was there as the police officers would not explain it to me. ( Val Stevens has agreed to be a witness to my state of mind and this phone call from the Port Pine Police Station - Val Stevens - mobile phone ) I stood freezing as I was surrounded by numerous police officers coming and going in and out of the back entrance door to the cubicle area as I held the icepack against the pain in my shoulder, as the police officers gathered around me asking questions. As the officers proceeded to ask questions I noticed someone looking at me through the venetian covers of the window at the back of the cubicle before closing it again. Constable proceeded to tum on a recording device and ask me questions in relation to the evenings events. As I was now quite shocked and panicked and in EFTA00266611 7 in a lot of confusion as to why I had been arrested, I refused to answer questiiiii replied to each question with " No comment ", as I stood staring at Constable and him at me. I complained that I was feeling very cold and two police officers proceeded to fetch me a blanket and wrap it around my shoulders and body to keep me warm before leading me to another cubicle area, behind me were I stood waiting. A police officer ( younger , dark longish shoulder length hair, shaven ) stood guard at the opened entrance of the cubicle. As I waited in the cubicle now in shock, panic as to what was going to happen next, very anxious and overwhelmed by the situation and the realisation that this may have been part of a planned attack of a sexual nature, I began to have flashbacks within my mind of a terrifying event / experience that I had suffered at the age of 19, which had left me with ( Police report - Moonta Police Station, restraining order was issued on the man involved through the Kadina Magistrates court ) I began to stutter and speak irrationally , outlining the details of this terrible event in my life and complaining of how the perpetrator ( boyfriend at the time ), got away with the crime and ,that I felt very unfairly treated as the victim of that crime was now being targeted by the Port Pirie Police Department. I had felt that the police officers had targeted an innocent victim as I have a clean police record - history and a long history of community involvement within Port Pirie. The younger male officer who stood at the entrance to the cubicle stood listening to my complaints, closin his e es at my comments and told me to be careful what I was saying about Constable and the other police officers. " So this is how you treat people do you, This is what you do ? ", I cried out, " You let my attacker go with a slap on the wrist after holding a knife to my throat and entrapping me in his house and you come hunting for me years later for standing on a beach watching fireworks ". The younger officer did not make a comment. After a period of time of waiting in the cubicle I was led by two accompanying officers ( the female officer from the beach and the younger male officer standing guard ), back to the open office cubicle area as the two officers proceeded to place rubber gloves on their hands as if to conduct an internal search of my person. I overheard another officer saying from the other room behind the cubicle, " That won't be necessary ". The two officers proceeded to remove the gloves off of their hands and throw them into the waste basket. I was then led by the two officers to the cell blocks with the blanket and icepack and locked into the cell. After about an hour a police officer came to the cell and asked me to blow into a breathalyser, I agreed and was informed that the reading was negative and the officer left. After about another thirty minutes I was taken out of the cell and led back to the open office cubicle area and was told that a DNA sample and my fingerprints had to collected according to the resisting arrest charges. The police officer proceeded to take a swab EFTA00266612 8 from the inside of my cheek and then I was led to a section with a machine that recorded your fingerprints. Due to the severe swelling and bruising of my wrists and arms, I had lost the mobility of the movement / rotation of my wrists and could not rotate my fingers properly to perform this duty. I was then led back to the open office cubicle area where I continued to ask the police officers " Why have I been arrested? ". I kept receiving the same response, For resisting arrest ", and was asked to sign the bail documents and release forms and was explained to me that the charge carried an instant 12 months suspension of my licence. I felt at the time that this was part of their planned attack to now immobilise me along with the many other inflictions of which had surrounded me from the suspicious and unusual activities. After being handed my belonging d handbag and re-dressing myself while standing with two police officers ( - name of one of the officers ) , I was told that the officers would escort me back to my place of residence and handed me the bail condition documents and informed me of the pending court date for my appearance. The other officer asked ( OfficerM ), if he would be allowed to drive my vehicle that had remained parked on the John Pine Island back to my place of residence. The officer la agreed. I was then told to meet the two officers out on the footpath in front of the Port Pirie Police Station and was led out of the station via a side entrance and proceeded to walk out onto the footpath and wait for the officers to arrive. I was placed into the back seat of the police vehicle ( enclosed plastic partition between the front / back seats of the inside of the police vehicle ) and escorted to the John Pine Island to the position of my parked vehicle. I asked the officer whom sat in the police vehicle with me (=) I I was able to collect some of my personal belongings out of my vehicle to which the officer ( agreed. As I approached my vehicle and started to collect my belongings I noticed a crushed can of one of the Wild Turkey bourbon cans from the front seat of my vehicle, placed strategically against the windscreen at the top of the bonnet of the vehicle next to my cigarettes that had been placed under the wiper blades of my vehicle and that there were only two cans of the Wild Turkey bourbon cans sitting inside the cardboard holder on the front passenger side seat. There had been three unopened cans of the Wild Turkey bourbon sitting within the cardboard holder on the passenger side seating upon my arrest. The fallen can of coke that had rolled under the front end of my vehicle upon my arrest was not in sight upon my return. I returned to the police vehicle and was escorted by the officer back to my place of residence as the other officer followed closely behind in my vehicle. As the police officer (= proceeded to escort me back to my place of residence he started to make small talk of a personal nature with me ( family's , lifestyles ) and as we approached the driveway of my residence and parked, I mentioned that I was not happy here anymore and that I was thinking of leaving the area. The officer ( ) replied , " Just leave and don't ever come back ". EFTA00266613 9 I found the comment to be very strange, intimidating and quite suspicious considering the current events that had been surrounding me over a long period of time. The other officer whom was driving my vehicle parked the vehicle in the next door neighbours driveway. I exited the police vehicle and walked towards the officer who proceeded to hand me my car keys. I said , " Thankyou very much ", to the officer for returning my vehicle to my place of residence. The officers then left. Upon entering my place of residence I looked into my bedroom mirror, shocked at the sight of the intensive bruising and swelling of the whole lengths of my arms and wrists to my shoulders. I proceeded to take photographs of the bruising and swelling on my mobile phone.
