I. 00802 Dear Mr. Vicars: Enclosed you will find Permit to Operate #'s STT-8-020-L-14 and STT-8-020-M-14 respectively, for the operation of: 1. one (1) 500 kW Caterpillar diesel generator, model # LC7, serial # G7A03132, engine model # C18, serial # EST01043 (Generator # 1) and, 2. one (I) 500 kW Caterpillar diesel generator, model # LC7, serial # G7A03133, engine model # C18, serial # EST01042 (Generator # 2), for standby use only. These pieces of equipment are located at Little St. James Island, V.I. This Permit to Operate is valid for a period of three (3) years. Be advised that, in accordance with 12 V.I. R. & Regs. § 206-28(a) (1995), the Commissioner may modify, suspend or revoke an authority to construct or permit to operate on any of the following grounds: (1) Materially false or inaccurate statements in the application or supporting papers; (2) Failure by the permittee to comply with any terms and conditions of the permit; (3) Exceeding the scope of the project as described in the application; (4) Newly discovered information or significant physical changes since the permit was issued; and (5) Non-compliance with any provisions of the Virgin Islands Code and Rules and Regulations directly related to the permitted activity. EFTA00309085 Danny Vicars L.S.J., LLC Permit to Operate #'s STT-8-020-L-14 and STT-8-020-M-14 Page 2 of 6 This source shall operate as a minor source and is subject to 40 Code of Federal Regulations (CFR), Part 60, Subpart IIII, "Performance Standards for Stationary Compression-Ignition of Internal Combustion Engines". A. GENERAL CONDITIONS 1. Permit to operate this source of air pollution does not relieve the L.S.J., LLC ("Permittee") of the responsibility for compliance with the provisions of any federal or territorial laws, rules or regulations. 2. This permit will become valid once it is signed by the Commissioner or his designee. 3. An application for renewal of a Permit to Operate shall be filed by the owner or operator at least sixty (60) days prior (which is on or before October 31. 2017) to the expiration of the existing Permit to Operate in accordance with 12 V.I. R. & Regs. § 206-27(bX3) (1995). 4. Revisions to this permit will not alter its effective date or expiration date. 5. If this permit is challenged by third parties, the effectiveness of the permit stands until any judicial court decides the contrary. 6. In the event of a sucrnsful challenge to any portion of this permit, all other portions of the permit shall remain valid and effective. B. OPERATING REQUIREMENTS 1. The pieces of equipment described above shall be constructed and operated only in accordance with the conditions set forth in this permit as well as the conditions described in the application, manufacturer's specifications and other supporting documentation. [49 C.F.R. 60.4211, 12 V.I. R. & Regs. §206-26(dX2) (1995), 12 V.I. R. & Regs. §206-27(cX2)] 2. Prior to operation at any other location, the Permittee shall submit a separate application for an authority to construct and permit to operate the equipment at each new location or construction project that will be conducted on non-contiguous property.[ 12 V.I. R. & Regs. §206-21(aX1995)] 3. Construction and operat on of the source must not result in the contravention of any federal or territorial ambient air quality standards. [12 V.I. R. & Regs. §206- 26(aX2); 12 V.I. R. & Regs. §206-27(a)(1XB)] 5. The Permittee shall operate the generator (emission unit) for standby use only. The use of the generator for prime power is prohibited.[40 C.F.R. 60.4211(f)] 6. The Permittee shall install and maintain a non-resettable hour meter to indicate the hours of operation of the engine. [40 C.F.R. 60.4209(a)] 7. The Permittee shall limit the use of the stand-by generator to no more than five hundred (500) hours of operation on a 365-day rolling average. 8. The Pennittee shall use a continuous operational fuel flow device to monitor the fuel consumption. 9. The Permittee shall use diesel oil with Sulfur content of 15 parts per million (ppm) maximum. [40 C.F.R. 80.510(b)] 10. The Permittee shall not emit any air contaminant that causes an opacity of more than twenty percent (20%) except during start up. [12 V.I. The Permittee shall operate the emission unit and maintain the achieved emission standards over the entire life of the engine. [40 C.F.R. 60.4206] 12. The Permittee shall install a backpressure monitor if the engine is equipped with a diesel particulate filter. C. MONITORING AND RECORDKEEPING 1. The Permittee shall maintain a logbook for each generator recorded on a monthly basis indicating but not limited to the following infonnation:[40 C.F.R. 60.4214(b)] a. date, time and number of hours of operation of the generator (emission unit) b. the reason for the operation of the generator such as power failure, start up, maintenance conducted, etc. c. quantity (in gallons) of fuel burned by the emission unit during the operation d. any malfunction of the emission unit, date, time, duration of occurrence and corrective action taken 2. The Permittee shall retain fuel purchase records that account for all fuel used in the generator and all fuel purchased for use in the emission unit. 3. All records required to be kept as part of this Permit shall be entered in indelible ink in a permanently bound logbook with pre-numbered pages. The logbook shall be maintained on site for a minimum of five (5) years after collection and shall be made available to representatives of the VIDPNR-DEP and USEPA upon request. 4. The Permittee shall maintain records of the sulfur content of the fuel oil received through the Supplier's Invoice with the attached Certificate of analyses performed. 5. The Permittee shall keep records of the summary of the annual fuel consumption. 6. The Permittee shall keep records of corrective action taken after the backpressure monitor has notified the Permittee that the high backpressure limit of the engine is approached if the engine is equipped with a diesel particulate filter. The Permittee shall report by telephone, within twenty-four (24) hours, all scheduled maintenance or upset conditions and breakdown situations that cause or have caused excess emission(s) or other violations(s), spill(s), leakage(s), loss of material, or any violation of territorial or federal laws, rules, or regulations. 2. The Permittee shall report any pre-existing or newly discovered spill or contamination situation both by phone and in writing. 3. The Permittee shall report to the VIDPNR-DEP via telephone and/or telefax immediately upon determination, any non-compliance with operating requirements directly related to emission limits, or any non-compliance with the conditions of this permit. The Permittee shall submit to the VIDPNR-DEP, within seven (7) days of the occurrence, a written report detailing the nature of the non-compliance. The written report shall include but not be limited to the time and place of the occurrence, who first reported the occurrence, amounts and type of material involved, corrective action taken, other agencies notified (who and when), any proposed mitigation, and proposed time frame for any mitigation. 4. Any operation of the equipment which may cause off-property effects, including odors, shall be immediately reported to the VIDPNR-DEP by the Permittee, in writing and by phone. 5. The Permittee shall report to the Virgin Islands Department of Planning and Natural Resources (VIDPNR-DEP) any physical change or changes in construction and operation that increase the amount of air pollutants or process production. 6. These reporting requirements in no way relieve the Permittee of any other reporting requirements for the above mentioned occurrences. 7. The Permittee shall report to the VIDPNR-DEP discontinuance of operation or dismantling of the emission unit. [12 V.I. R. & Regs. §204-31(1995)] 8. The Permittee shall submit records of the annual fuel consumption of the generator and the number of hours of operation when the facility applies for permit to operate renewal. As a condition of this Permit, the Permittee shall comply with all terms and conditions of any Administrative Order related to any violation of conditions of this Permit. 2. The VIDPNR-DEP reserves the right to inspect the Permittee's facilities. The Permittee shall give the VIDPNR-DEP whatever aid is necessary to perform inspections without delay in a safe manner. The Permittee shall keep the area clean where the generator is located. 3. A person who has been granted a permit under the provisions of the 12 V.I. R. & Regs. § 206-20(a) and (c) (1995), shall firmly affix such Authority to Construct permit and Permit to Operate, an approved facsimile, or other approved identification bearing the permit number upon the article, machine, equipment, or other contrivance in such a manner as to be clearly visible and accessible in accordance with 12 V.I. R. & Regs. § 206-20(d) (1995). In the event that the article, machine, equipment, or other contrivance is so constructed or operated that the Permit to Operate cannot be so placed, then the permit should be maintained so as to be readily available at all times on the construction and operating premises. 4. The Permittee is required to be in compliance with 12 V.I. R. & Regs. § 206- 27 (1995). Your cooperation in complying with these regulations will be most appreciated.
