DOMESTIC FLIGHTS: Each passenger 18 years of age and older will be required to present a government issued Photo ID at each departure to comply with TSA 12-5 Regulations. Both parents and or legal guardians must vouch for passengers under the age of 18. Customer hereby certifies and guarantees to hold harmless Injet and its agents from any deviation or intentional disregard to this requirement by Customer or Customer representatives. 2. INTERNATIONAL FLIGHTS: The Customer is responsible for ensuring all passengers have all required travel documentation- including passports, visas or documents pertinent to the destination. All documents required for international travel must be presented to the flight crew for review before boarding. Client will be fully financially responsible for flight costs and any and all fines caused by incorrect or false documentation presented to authorities CHARTER SERVICES: So long as the Customer is in compliance with this agreement InJet. LLC will act as an agent of the contracted flights for the Customer in accordance with and subject to the terms and conditions of this agreement. The contractor will operate the flights in order to transport passengers in accordance with the provisions of FAR Part 135. The contractors crew members shall be in command of the aircraft at all times, shall be entitled to make all decisions regarding the boarding (or refusal to board) any passengers and acceptance or rejection of any baggage for flight. Baggage: InJet, LLC is not responsible for shipping excess (or rejected) baggage. If the Customer provides more luggage than will fit in the designated baggage area of the aircraft, InJet. LLC will assist with the shipment of excess items at the Customer's expense. RESPONSIBILITY: InJet. LLC shall not be liable for any injury, damage, loss, expense, indirect. special or consequential damages. or other irregularity caused by the defect of any vehicle or conveyance, or the negligence of any company or person engaged in conveying the passenger or carrying out the arrangements for your trip or by accident, delay, flight schedule. change. cancellation, sickness. weather, strikes. acts of war, quarantine. force majeure. or any similar cause. LLC selected FBO. ITINERARY CHANGES AND TRANSMITTAL OF CHANGES: Itinerary changes are permitted. but subject to aircraft and crew availability and subject to price adjustment. Notification of changes and/or cancellations must be in writing and transmitted by fax to (561) 686-5922 within the cancellation terms listed above. The change is not valid until a representative of ACP Jets acknowledges in written format whether Fax or Electronic the receipt and acceptance of such change and the customer has authorized any additional charges as a result of a change. PARTIAL COMPLETION OF FLIGHTS: If a flight does not reach it's destination due to weather or government directive, Customer will be responsible for all costs to any destination reached and return flight of aircraft and crew (with or without passengers) to home base or other suitable airport. In the case of mechanicals, InJet. LLC may at its option provide substitute transportation that can be charged as an additional fee to the Customer. Customer understands and accepts full responsibility for any cost incurred beyond those already agreed to in the original quote and must be approved by Customer before any additional costs are incurred. CANCELLATION: Some charters require significant planning prior to the date of departure under which costs are incurred by InJet. LLC. Under such circumstances the undersigned agrees to be responsible for the actual costs incurred by InJet, LLC in preparation of the trip in addition to any cancellation policy that may apply. Such costs may include, but are not limited to. aircraft handling services. international permits. airline tickets and crew hotel rooms. One way Charter Terms = 100% cancellation fee. Round Trip Charter Terms = One hour flight charge from signing on all flights, 2 hr flight charge within 72 hours, 50% Charge within 48 hours. 100% Charge within 24 hour PEAK TRAVEL DAYS: 100% cancellation fees apply to any charter flight whether one-way or round trip upon booking during Peak travel periods. For the purpose of this agreement a Peak Travel period is defined as 3 days prior to until 3 days after any official US national holiday listed on www.opm.gov JURISDICTION: Each of the parties hereby submits to personal jurisdiction in the State of Florida in connection with any disputes or controversies arising under the agreement or enforcement hereof. (b) shall be governed by and construed in accordance with the substantive laws of the State of Florida: (c) may not be altered or amended except pursuant to a written agreement signed and delivered to both parties: (d) shall be binding upon and inure to the benefit of the parties hereto and their respective successor and permitted assigns and (e) may be executed via facsimile and multiple counterparts.
